Making A Reservation and Acceptance of Travel Agreement

A refundable deposit of 30% per person is required to complete your reservation.  You are accepting this Travel Agreement upon making the deposit and completing your reservation. Unless indicated otherwise, if you need to cancel your reservation more than 45 days before the start date of the trip, you will receive a refund of your deposit less a $100 processing fee per person. The remaining unpaid balance is due 45 days before the start date of the trip.  If you need to cancel your reservation less than 45 days before the start date of the trip, your trip is considered non-refundable and you will be required to pay the remaining unpaid balance owed. If your trip is cancelled by Euro Trotter Travel Experiences for any unforeseen reason, you will receive a 100% refund.

Late Payment

If full payment is not received on-time (45 days or more before the start date of the trip), you may be at risk of having your trip cancelled. If cancelation occurs, you will not receive a refund of the deposit.

What's Not Included

The price of the trip does not include: airfare, trip insurance, fees for passports and visas, local city and tourism taxes, airport taxes, and miscellaneous airline charges, food and drink not outlined in the The Euro Trotter Experience section of the trip on markfelice.com/trips and Welcome Kit, activities and excursions not listed on the itinerary, cell phone carrier charges, additional service charges incurred for included activities and excursions in the itinerary and as outlined in The Euro Trotter Experience section of the trip on markfelice.com/trips and Welcome Kit.

Airfare Cancelation

Euro Trotter Travel Experiences will not be held responsible for the cost of canceled, non-refundable airline tickets, or the associated cancelation fees and penalties.

Travel Insurance

Guests are encouraged to purchase travel insurance, or use a credit card that provides travel insurance. 

​

 

Passports & Visas

It is your responsibility to adhere to all passport and visa requirements. For U.S. passport holders, the expiration date on your passport must be at least 6 months after your return date for the trip.

Welcome Kit 

A Welcome Kit is provided to each guest after completing your reservation. The Welcome Kit details important information regarding your accommodations, the itinerary, contact information for your host, and planned activities and excursions.

Accommodations

The featured property or properties may be subject to change. If that is the case, a similar or better property will be secured for the trip.

Cancellation and Re-Schedule

Unless indicated otherwise, if you need to cancel your reservation more than 45 days before the start date of the trip, you will receive a refund of your deposit less a $100 processing fee per person. The remaining unpaid balance is due 45 days before the start date of the trip.  If you need to cancel your reservation less than 45 days before the start date of the trip, your trip is considered non-refundable and you will be required to pay the remaining unpaid balance owed. If your trip is cancelled by Euro Trotter Travel Experiences for any unforeseen reason, you will receive a 100% refund. 

 

If Euro Trotter Travel Experiences needs to reschedule or cancel the trip due to a host of unforeseen reasons including but not limited to natural disasters and other uncontrollable events that may impact the safety of guests and staff, Euro Trotter Travel Experiences will attempt to reschedule the trip in accordance with your schedule and availability. Euro Trotter Travel Experiences cannot guarantee that there will be not be fluctuations in price as pricing may change with the accommodations and various service providers. If the rescheduled trip is not suitable to your needs and schedule, you can decide not to move forward with the rescheduled trip. In that event, and if you so choose, Euro Trotter Travel Experiences can hold your deposit and monies paid as a travel credit for a future trip with Euro Trotter Travel Experiences (you must book your future trip with Euro Trotter Travel Experiences within 12 months), or you can receive a 100% refund.

 

Traveling Solo

Single travelers are welcome, but rooms and rates are per person based on double occupancy. Should your travel companion decide to cancel, we will attempt to "buddy you up" with another single traveler (which means you will be sharing a room), but the ultimate responsibility is yours to find a travel companion.

Euro Trotter Travel Experiences Exclusive Right to Cancel or Adjust

Euro Trotter Travel Experiences maintains the exclusive right to cancel or adjust the trip, including but not limited to the itinerary, accommodations, activities and excursions as needed. In this event, and as previously outlined in this Travel Agreement, Euro Trotter Travel Experiences will make every attempt to reschedule the trip for a time that is mutually agreed upon between you (the Guest) and Euro Trotter Travel Experiences.

The itinerary is subject to change based on unforeseen circumstances including but not limited to interruptions from weather and natural disasters, availability of services and service providers, strikes, pandemics, terrorism, war, and civil and economic unrest. Euro Trotter Travel Experiences is not liable for any damage or losses incurred during your trip changes or cancellations resulting from, but not limited to, these unforeseen circumstances.

Rates and Acceptance of Reservations
All rates are per person based on double occupancy. Your reservation will be accepted based on the availability of the desired room at the time of booking and will be only be considered complete upon receiving the Welcome Kit from Euro Trotter Travel Experiences.

Medical Conditions and Travel Assistance

Some of our planned activities and excursions include a certain level of physical exercise such as walking, swimming, and boating.  It is your responsibility to asses the necessary level of activity and your capability to participate in the activity, excursion or trip as a whole. Please disclose any physical limitations or medical conditions in your Guest Profile form, such as an existing physical or mental illness or disability, if you are pregnant, or if you have any other physical or mental condition that may jeopardize your health or the health and safety of others on the trip, or for you may require special medical attention or physical assistance during the trip. Euro Trotter Travel Experiences will, as required by law such as the A.D.A, attempt to assist with any special needs, however, anyone requiring special assistance to get in and our of a car, walking, eating, drinking or other special needs, should strongly consider not going on the trip as Euro Trotter Travel Experiences will not be able to provide that level of assistance.

Damage and Loss Disclaimer

Euro Trotter Travel Experiences is not responsible for any damage to baggage, including loss, during the trip. Euro Trotter Travel Experiences is not liable for any loss from theft of personal items such as jewelry, cash, passports, credit cards, wallets, purses and other items of monetary or sentimental value. It is your responsibility to secure these items. You are encourage to purchase travel insurance to protect against such risks.

General Disclaimer

Euro Trotter Travel Experiences acts as an agent as it relates to the coordination and booking of all accommodations, transportation by car, van, bus, golf cart, and boat, and for all planned activities and excursions. Euro Trotter Travel Experiences has no control over the staff operators, and equipment of such suppliers. As such, Euro Trotter Travel Experiences assumes no responsibility or liability for any personal injury or property damage or other loss or accident which may be incurred by any wrongful or negligent or unauthorized acts or omissions on the part of any of the suppliers; any wrongful, negligent, or unauthorized acts or omissions on the part of any employee of any of these suppliers; any defect in or failure of any vehicle, equipment, or instrument owned, operated or otherwise used by any of these suppliers; or any wrongful or negligent acts or omissions on the part of any other party not under the supervision and control, direct or otherwise, of Euro Trotter Travel Experiences. You hereby release Euro Trotter Travel Experiences from all claims arising out of any problem covered in this paragraph.
 

Euro Trotter Travel Experiences will not be held liable if a guest does not like the travel experience, including the country, city, region, food, and weather while traveling with Euro Trotter Travel Experiences. 
 

Guests will be held responsible, should it be their fault, for any damage incurred to the accommodations or provided transportation during the trip.

Euro Trotter Travel Experiences does not discriminate based on race, gender, age, religion, sex, or sexual orientation. Euro Trotter Travel Experiences reserves the right to refuse service to anyone showing signs of discrimination or violent behavior as it is our intent to provide a safe and pleasant experience for all travelers.

​

If you behave in a disorderly or physically or verbally violent or abusive fashion, Euro Trotter Travel Experiences may deem you unfit to continue with the trip. In that event, Euro Trotter Travel Experiences will not be liable for any unused portion of the trip or additional expenses incurred to secure your return trip home.

​

No consequential damages: In no event will Euro Trotter Travel Experiences be liable for any direct, indirect, incidental or substitute products, arising out of your selection of or participation in any trip or other service offered by Euro Trotter Travel Experiences, even if we have been advised of the possibility of such damages. In any event, the maximum damages that may be assessed against Euro Trotter Travel Experiences for any claim, injury, loss or damage of any kind or nature whatsoever shall be the amount in U.S. Dollars actually paid by you and retained by Euro Trotter Travel Experiences. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation and exclusions may not apply to you.

Mediation and Arbitration Agreement (Waiver of Trial by Jury)

Any controversy or claim arising out of or relating to this Travel Agreement, to the website or marketing in any way to the trip, or to the trip itself, shall first be presented by the parties to non-binding mediation, which must be conducted within 60 days after written notice of any such claim is delivered by the aggrieved party to the other party. The mediation may be conducted in person, but either party may attend by video conference or teleconference, in their sole discretion. Legal representation is at the option of the parties. The costs of the mediator shall be paid in advance, one half by Euro Trotter Travel Experiences and the balance by the guest(s). Each side shall otherwise bear all of their other costs and expenses associated with the mediation, including attorney’s fees.

If the dispute cannot be resolved through mediation, then, only after the mediation has occurred and been unsuccessful, a party remaining aggrieved must submit it’s claims solely and exclusively to binding arbitration to be conducted in Denver, Colorado, in accordance with the then existent commercial rules of the American Arbitration Association. In any such arbitration, the substantive

(but not procedural) law of Colorado shall apply. The claim(s) will be decided by a single arbitrator who shall have at least ten years experience in business law and civil litigation. The Arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable. Euro Trotter Travel Experiences and you will each have the option, exercised in your respective sole discretion, to participate in any arbitration by video conference and not in person, and to call witnesses to attend by video conference or telephone. The Arbitrator is authorized to use fair procedures to ensure authenticity of witnesses and evidence presented in such fashion. The filing fee for the Arbitration shall be borne by the party initiating it. The fees for the service of the Arbitrator shall be borne one half by Euro Trotter Travel Experiences and the balance by the guest(s). Each party shall otherwise bear their own costs and expenses associated with the Arbitration, including attorney’s fees.

BY AGREEING TO BINDING ARBITRATION, YOU ARE IRREVOCABLY WAIVING YOUR RIGHT TO TRIAL BY JURY OR BY ANY OTHER COURT OR TRIBUNAL THAT MIGHT EXIST IN YOUR HOME JURISDICTION. YOU ARE CONSCIOUSLY AND INTENTIONALLY SELECTING ARBITRATION BECAUSE YOU AGREE THAT IT IS BEST SUITED TO RESOLVE DISPUTES INVOLVING THIS TRAVEL AGREEMENT.

Miscellaneous Provisions

This Agreement contains the entire agreement by and between the Parties, relative to the business arrangement provided for herein. No amendment, waiver or discharge of any provision of this Agreement shall be effective against any Party unless that Party shall have consented thereto in writing.

​

This Agreement shall be binding upon and shall inure to the benefit of the parties hereto and their respective heirs, personal representatives, successors and assigns.

​

No failure or delay in exercising any rights or remedies pursuant to this Agreement shall constitute a waiver of any other right or remedy pursuant hereto. Resort to one form of remedy shall not constitute a waiver of other available remedies.

​

This Agreement may be executed in counterparts by the parties hereto, each of which shall constitute an original of this Agreement and all of which, when taken together, shall constitute one and the same instrument. The parties hereto intend that facsimile copies of fully executed counterparts of this Agreement shall be binding and enforceable.

​

A ruling by any court that one or more of the provisions contained in this Agreement is invalid, illegal or unenforceable in any respect shall not affect any other provision of this Agreement. Thereafter, this Agreement shall be construed as if the invalid, illegal or unenforceable provision had never been included, but only within the jurisdiction of the court making the ruling.

​

If suit is brought to enforce any of the provisions of this Agreement, then the prevailing party shall be paid by the other party all of the prevailing party’s costs and expenses of prosecuting and/or defending the suit, including, without limitation, the reasonable attorneys’ fees, court costs and expenses of the prevailing party.

​

Entire Agreement. Guest warrants that no promises or inducements have been offered for this Travel Agreement other than as set forth herein and that this Travel Agreement is executed without reliance upon any other promises or representations. No modification, termination, or attempted waiver of this Travel Agreement shall be valid unless in writing and signed by the guest and Euro Trotter Travel Experiences.
